Terms of Service
The plain-language agreement between Lumifit and the gyms that run on it. No traps, no fine-print games.

1. Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between Lumifit (“Lumifit”, “we”, “us”), operator of lumifit.in, and the business that registers for an account (“you”, “your gym”). Lumifit is a business-to-business platform: by creating an account you confirm that you are acting on behalf of a gym or fitness business, that you are at least 18 years old, and that you have authority to bind that business. If you do not agree to these Terms, do not use the platform.
2. The service
Lumifit provides a white-labeled, web-based operating system for gyms, including (depending on your plan): a retention and re-engagement engine, a workout engine with exercise library and session logging, an automated communication hub (Web Push, Telegram, WhatsApp, SMS), Google Sheets synchronisation (“Trust Mode”), and a branded progressive web app (PWA) for your members. Features vary by plan as described on our Pricing page.
3. Accounts and access
- You are responsible for the accuracy of the information on your account and for keeping login credentials confidential.
- You may create staff accounts (for example, trainers). You are responsible for the actions of everyone who accesses the platform under your account.
- Member access is provided through secure magic links. You must not share, publish or forward a member's personal magic link to anyone other than that member.
4. Subscription, trials and billing
- Free trial. New gyms receive a 14-day free trial. No payment card is required to start. At the end of the trial, you choose a paid plan or your account becomes read-only.
- Plans and pricing. Current plans and prices are listed on the Pricing page. Prices are in Indian Rupees and exclusive of GST, which is added on invoices where applicable.
- Billing cycle. Subscriptions renew automatically — monthly or annually depending on your selection. Annual plans are discounted as shown at checkout.
- Plan limits. Each plan includes limits (for example, member count or locations). If you exceed your plan's limits we will ask you to upgrade; we will never silently bill you for an overage.
- Changes. You can upgrade at any time (effective immediately, prorated) or downgrade effective from your next billing cycle.
- Price changes. We may change prices with at least 30 days' written notice. Changes never apply mid-cycle to an already-paid period.
- Cancellation and refunds are governed by our Refund & Cancellation Policy.
5. Acceptable use
You agree to use the platform only to operate your fitness business. You must not:
- send spam, marketing blasts to purchased contact lists, or any message to a person who has not consented to hear from your gym;
- upload unlawful, infringing or harmful content — including to your exercise library or branding assets;
- attempt to probe, breach or circumvent security or tenant isolation, or access another gym's data;
- reverse-engineer, copy, resell or sublicense the platform, or use it to build a competing product;
- use the messaging hub in violation of WhatsApp, Telegram or telecom regulations applicable to you, including India's TRAI commercial-messaging rules;
- misrepresent the platform as your own development when dealing with regulators or payment providers (white-label branding toward your members is, of course, exactly what the product is for — see Section 7).
We may suspend accounts that put the platform, its users or message-channel integrity at risk. Where practical, we will warn you first and give you a chance to fix the issue.
6. Your members and their data
- For member personal data, your gym is the data fiduciary and Lumifit acts as your data processor, as described in our Privacy Policy.
- You confirm you have the legal right to upload your members' details and that you have obtained the consents required to message them on the channels you enable.
- You are responsible for honouring member opt-outs; the platform provides the tools to record and enforce them across channels.
- In Trust Mode, you remain the owner of your Google Sheet and can disconnect it at any time.
7. White-label terms
- On eligible plans, you may apply your gym's name, logo and brand colours to the member-facing PWA and to messages sent through the platform.
- You warrant that you own or are licensed to use every brand asset you upload, and you indemnify us against third-party claims arising from those assets.
- White-labeling grants no ownership of the underlying software. Lumifit retains all rights in the platform, and your branding licence to us is limited to displaying your assets within your own tenant.
- Member-facing surfaces may include a discreet “Powered by Lumifit” notice except where your plan provides full white-label removal.
- On termination, your branding is removed and your member portals are deactivated.
8. Third-party services and integrations
Message delivery depends on third-party channels (for example Twilio, WhatsApp Business, Telegram) and, in Trust Mode, on Google Sheets. Where you connect your own credentials, your relationship with those providers — including their fees and policies — is between you and them. We are not responsible for outages, delivery failures or policy changes on third-party networks, though our omnichannel fallback is designed to route around individual channel failures where possible.
9. Intellectual property
- Lumifit owns the platform, its software, design, exercise-library structure and documentation. We grant you a limited, non-exclusive, non-transferable right to use them for your business while subscribed.
- You own your data: your member records, attendance logs, workout templates you author, and your brand assets. You can export your data at any time.
- Feedback you send us may be used to improve the product without obligation to you.
10. Availability and support
We work to keep the platform available around the clock, but we do not guarantee uninterrupted service. Planned maintenance is announced in advance where practical. Support is provided by email at contact@lumifit.in; priority support response targets apply on eligible plans as described on the Pricing page.
11. Disclaimers
- The platform is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
- Lumifit is software, not medical or fitness advice. Workout templates and exercise content are tools for your trainers; your gym remains solely responsible for the safety and suitability of training programmes assigned to members.
- Retention analytics and engagement nudges are aids to your business judgement — we make no guarantee of member retention or revenue outcomes.
12. Limitation of liability
- To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, goodwill or data.
- Lumifit's total aggregate liability arising out of or relating to the service is limited to the subscription fees you paid in the 12 months preceding the claim.
- Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or wilful misconduct.
13. Indemnity
You will indemnify and hold Lumifit harmless from third-party claims arising out of (a) your breach of these Terms, (b) member communications sent without valid consent, or (c) brand assets or content you upload that infringe third-party rights.
14. Termination
- You can cancel at any time from your dashboard or by emailing us; cancellation takes effect at the end of the current billing period, per the Refund & Cancellation Policy.
- We may suspend or terminate your account for material breach of these Terms that remains uncured 15 days after written notice, or immediately for serious abuse (Section 5) or non-payment.
- After termination you have 30 days to export your data, after which it is deleted in line with our Privacy Policy.
15. Governing law and disputes
These Terms are governed by the laws of India. The parties will first attempt to resolve any dispute in good faith within 30 days of written notice; failing that, disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.
16. Changes to these terms
We may update these Terms from time to time. For material changes we will notify gym owners by email at least 15 days before they take effect and update the date at the top of this page. Continued use after the effective date constitutes acceptance.
